HKPAPA Aerospace Youth Ambassador Program Terms and Conditions & Liability Waiver

These Terms and Conditions ("Terms") constitute a legally binding agreement between the participant and the Hong Kong Professional Airline Pilots Association Limited ("HKPAPA" or "the Association") and apply to participation in the Aerospace Youth Ambassador Program ("Program"). By registering for the Program, participants (or their legal guardians if the participant is under 18 years of age) confirm that they have read, understood, and agree to be bound by these Terms.

1. Introduction

1.1 These Terms apply to all participants of the Program organized by HKPAPA.

1.2 Participants (or their legal guardians if the participant is under 18 years of age) agree to comply with and be bound by these Terms.

1.3 Upon completing the online registration process, participants (or their legal guardians) are deemed to have accepted and agreed to be bound by these Terms, which shall have full legal effect.

1.4 Participants (or their legal guardians) must provide accurate and up-to-date emergency contact information during the registration process. HKPAPA reserves the right to contact this person in the event of an emergency.

1.5 In the event of any discrepancies between the Chinese and English versions of these Terms, the English version shall prevail.

1.6 Any disputes arising out of or in connection with these Terms shall first be resolved through good faith negotiation. If unresolved, the matter shall be referred to mediation administered by the Hong Kong International Arbitration Centre (HKIAC) and, if necessary, arbitration under HKIAC rules.

1.7 By accepting these Terms, participants (or their legal guardians) acknowledge that they have read, understood, and accepted the specific risks associated with aviation activities, including but not limited to operating light aircraft and visiting restricted areas.

1.8 Participants (or their legal guardians) represent and warrant that all information provided during the registration process is true and accurate. HKPAPA reserves the right to remove any participant providing false or misleading information, without refund or compensation.

2. Program Participation

2.1 Participants understand that the Program involves visits to operational environments such as airports, control towers, and other restricted areas, as well as the operation of machinery, including light aircraft.

2.2 Participation in the Program is entirely voluntary. Participants assume all associated risks, including the risk of serious injury or death.

2.3 Participants agree to comply with all safety regulations and instructions provided by HKPAPA personnel or authorized representatives during the Program.

2.4 Participants acknowledge that the Program is an educational initiative designed to provide exposure to the aviation industry. It does not guarantee employment, certifications, or specific outcomes.

3. Third-Party Flying Lessons

3.1 Trial flying lessons offered as part of the Program are provided by third-party organizations certified by the Civil Aviation Administration of China (CAAC).

3.2 Participants acknowledge that HKPAPA is not responsible for the actions, omissions, or conduct of third-party organizations or their personnel.

3.3 Participants expressly assume all risks associated with trial flying lessons and waive any claims of liability against HKPAPA and its officers, directors, employees, agents, contractors, and affiliates ("Released Parties") for any accidents, incidents, injuries, losses, or damages arising out of or related to the flying lessons.

3.4 HKPAPA shall not be held responsible for any acts, omissions, or negligence of third-party providers engaged in the Program. Participants (or their legal guardians) agree to indemnify HKPAPA against any claims arising from third-party services.

4. No Cancellation, Refund, or Exchange

4.1 Once registration is confirmed, a participant’s place in the Program is secured. Due to the nature of the Program, cancellations, refunds, or exchanges are not permitted under any circumstances.

4.2 HKPAPA will make reasonable efforts to notify participants of any changes to the Program schedule but shall not be held liable for any losses or liabilities arising from such changes.

5. Medical Fitness

5.1 Participants must be in good physical and mental health to participate in the Program. Any known medical conditions or allergies must be disclosed to HKPAPA prior to the start of the Program.

5.2 HKPAPA reserves the right to deny participation to individuals deemed medically unfit to safely participate in the Program.

5.3 Participants (or their legal guardians) are responsible for ensuring that they have adequate personal medical insurance coverage for any injuries or losses that may occur during the Program.

6. Code of Conduct and Compliance

6.1 Participants are required to comply with all instructions provided by HKPAPA staff, third-party instructors, and other authorized personnel during the Program.

6.2 In the event that a participant fails to follow instructions or engages in any inappropriate behavior, HKPAPA reserves the right to immediately remove the participant from the Program without refund or compensation.

6.3 Participants (or their legal guardians) shall bear full financial responsibility for any damage to equipment, property, or facilities caused by their actions during the Program. This includes, but is not limited to, repair, replacement, medical, and legal costs.

7. Assumption of Risk and Liability Waiver

7.1 Participants (or their legal guardians) acknowledge that participation in the Program involves inherent risks, including but not limited to the risk of serious injury or death.

7.2 By participating in the Program, participants (or their legal guardians) expressly assume all such risks and waive any claims of liability against HKPAPA and its officers, directors, employees, agents, contractors, and affiliates ("Released Parties") for any injuries, losses, or damages arising out of or in connection with the Program.

7.3 The Released Parties shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from participation in the Program, including but not limited to loss of profits, goodwill, data, or other intangible losses, even if the possibility of such damages has been advised.

8. Indemnification

8.1 Participants (or their legal guardians) agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, damages, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of or related to participation in the Program or any damages caused by the participant.

9. Force Majeure

9.1 HKPAPA shall not be held responsible for any delay or failure to fulfill its obligations under these Terms caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, wars, strikes, or government restrictions.

9.2 In the event of a force majeure, HKPAPA reserves the right to cancel, postpone, or modify the Program without obligation to provide refunds or compensation.

10. Governing Law and Dispute Resolution

10.1 These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong").

10.2 Any disputes arising out of or in connection with these Terms shall be referred to and resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) in accordance with its effective arbitration rules. The seat of arbitration shall be Hong Kong, and the language of arbitration shall be English.

10.3 In cases involving cross-border activities, disputes shall remain governed by Hong Kong law unless explicitly stated otherwise. HKPAPA assumes no liability for jurisdictional conflicts arising from cross-border operations.​

11. Data Protection and Privacy

11.1 HKPAPA is committed to safeguarding participants' privacy and will collect, use, and store personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486).

11.2 Personal data collected during the registration process and throughout the Program will be used solely for program administration, safety, and communication purposes.

11.3 By enrolling in the Program, participants (or their legal guardians) consent to HKPAPA’s collection, use, and storage of their personal data as outlined in these Terms.

12. Media Release

12.1 Participants (or their legal guardians) grant HKPAPA permission to use photographs, videos, and other media captured during the Program for promotional, educational, or commercial purposes without compensation.

12.2 Participants (or their legal guardians) waive any rights to review or approve the final media content or any associated printed or digital materials.

13. Reservation of Rights

13.1 HKPAPA reserves the right to modify, amend, or cancel any part of the Program at its sole discretion without prior notice, including but not limited to changes in schedules, activities, or instructors.

13.2 HKPAPA will make reasonable efforts to inform participants of significant changes but is not obligated to provide refunds or compensation for such modifications.

13.3 All materials, content, and intellectual property provided during the Program remain the exclusive property of HKPAPA. Participants are prohibited from reproducing, distributing, or using such materials for any purpose without HKPAPA’s prior written consent.​

13.4 HKPAPA reserves the right to cancel or discontinue the Program for operational or regulatory reasons. In such cases, HKPAPA shall have sole discretion to offer rescheduling or credit toward future programs as a remedy.

14. Acknowledgment

14.1 By enrolling in the Program, participants (or their legal guardians) confirm that they have read, understood, and agree to be bound by these Terms.

15. Parental Consent for Minors

15.1 If the participant is under 18 years of age, their legal guardian must provide written consent for the participant’s enrollment in the Program. Such consent must include acknowledgment of all Terms, including risk assumption, liability waiver, and indemnification clauses.

15.2 Legal guardians assume full responsibility for the actions of minor participants during the Program and ensure compliance with all Terms and HKPAPA’s policies.

16. Force Majeure

16.1 HKPAPA shall not be liable for any delays or failures to perform its obligations under these Terms caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, wars, strikes, or government restrictions.

16.2 In the event of a force majeure, HKPAPA reserves the right to cancel, postpone, or modify the Program without any obligation to provide refunds or compensation.

16.3 In the event of a force majeure, HKPAPA reserves the right to reschedule affected portions of the Program or offer credit toward future participation. Refunds shall not be provided.​

17. Data Protection and Privacy (Reiterated)

17.1 HKPAPA reiterates its commitment to safeguarding personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486).

17.2 Personal data collected will be used exclusively for program management, safety, and communication purposes.

17.3 By enrolling in the Program, participants (or their legal guardians) reaffirm their consent to the collection, use, and storage of personal data as per these Terms.

17.4 Personal data collected during the Program will be retained for as long as necessary to fulfill its purposes, including compliance with legal and regulatory requirements.

18. Media Authorization

18.1 Participants (or their legal guardians) grant HKPAPA the right to use photographs, videos, and other media taken during the Program in perpetuity for promotional, educational, or commercial purposes, across all platforms, without any geographic or temporal restrictions.

18.2 Participants (or their legal guardians) waive any rights to review or approve final media content.

19. Compliance with Aviation Regulations

19.1 Participants acknowledge that the Program involves activities regulated by aviation authorities, including the Civil Aviation Administration of China (CAAC) and relevant Hong Kong authorities.

19.2 Participants agree to comply with all applicable aviation laws, regulations, and rules and to follow instructions from authorized personnel.

20. Emergency Protocols

20.1 HKPAPA has established emergency response protocols to address incidents that may occur during the Program. These include first aid measures, evacuation procedures, and communication with guardians in emergencies.

20.2 Participants must follow all emergency instructions provided by HKPAPA staff or authorized personnel during the Program.

21. Governing Law and Cross-Border Considerations

21.1 Participants acknowledge that the Program may involve activities subject to the laws and regulations of multiple jurisdictions, including Hong Kong and Mainland China.

21.2 Participants agree to take sole responsibility for complying with all applicable laws in each jurisdiction. HKPAPA shall not be held liable for any legal issues arising from cross-border activities.

22. Participant Code of Conduct

22.1 Participants are expected to behave in a respectful and responsible manner throughout the Program, including adhering to all safety instructions, respecting property, and following the guidance of HKPAPA staff and third-party instructors.

22.2 Any participant who fails to comply with the Code of Conduct may be immediately removed from the Program without refund or compensation.

22.3 Participants removed from the Program due to misconduct shall bear all costs associated with their removal, including but not limited to transportation and administrative costs.​

23. Extended Indemnification

23.1 In addition to indemnifying HKPAPA, participants (or their legal guardians) agree to indemnify, defend, and hold harmless any third-party contractors, service providers, or instructors involved in the Program, including CAAC-certified flying organizations or schools, from any and all claims, demands, damages, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of or related to participation in the Program.

24. Health and Safety Disclaimer

24.1 Participants acknowledge that participation in the Program may require adherence to specific health and safety protocols, including wearing protective gear and following safety procedures.

24.2 Failure to comply with health and safety requirements may increase the risk of injury. Participants (or their legal guardians) assume full responsibility for any consequences resulting from non-compliance.

​24.3 Participants acknowledge that certain high-risk activities, such as flight simulations and restricted-area access, may require additional safety measures. By participating, they voluntarily assume these risks and waive all claims against HKPAPA.

25. Program Modifications Due to Operational Reasons and Periodic Review

25.1 Participants acknowledge and agree that, due to the nature of the Program, HKPAPA reserves the right to modify the Program at any time and for any reason, including but not limited to operational, safety, or regulatory requirements.

25.2 Such modifications may include, but are not limited to, the addition, cancellation, rescheduling, or postponement of any lessons, activities, or events included in the Program.

25.3 HKPAPA will make reasonable efforts to notify participants of any significant changes to the Program as early as practicable.

25.4 In the event of such modifications, participants shall not be entitled to any refund, compensation, or other remedy unless HKPAPA, in its sole discretion, decides otherwise.

25.5 HKPAPA shall not be held liable for any losses, damages, or inconveniences arising from Program modifications, including but not limited to changes in schedule, activities, instructors, or locations.

26. Periodic Review

26.1 HKPAPA reserves the right to periodically review and update these Terms to ensure compliance with legal standards and industry practices.

26.2 Participants (or their legal guardians) will be notified of any significant changes to these Terms. Continued participation in the Program constitutes acceptance of the updated Terms.

27. Reservation of Rights

27.1 HKPAPA reserves all rights to modify, amend, or cancel any part of the Program at its sole discretion without prior notice, including but not limited to changes in schedules, activities, or instructors.

28. Conclusion

28.1 These Terms constitute the entire agreement between the participant and HKPAPA regarding the Program and supersede any prior written or oral agreements related to it.

28.2 HKPAPA reserves the right to make the final interpretation of any matters not explicitly addressed in these Terms.

28.3 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
